Frequently Asked Questions Regarding Probation Periods

  • Can you terminate employment in probationary period?

    Yes, if your contract of employment provides for a probation period which allows for termination, then you can terminate an employee's employment, provided they have had an opportunity to improve their perfomance if that is the issue,  upon the giving of statutory notice or notice in accordance with the contract. 

  • What does probation period mean?

    A probation period is a trial period, which allows both the employer and the employee to decide if the new role they have taken up is a good fit. 

  • Can an employer extend your probationary period?

    An employer can extend your probation period in limited circumstances. Your contract of employment must allow for this, and  it must be in the interest of the employee to do so. 

  • Do you have to give notice during a probationary period?

    Yes, notice should be provided in accordance with the Minimum Notice and Terms of Employment Act 1973 upon the completion of thirteen weeks service, or notice as outlined in the contract, whichever is the greater of the two.

  • Can you get fired for being pregnant during probation period?

    No, it is prohibited under the Employment Equality Acts and the Pregnancy Directive, to terminate someones' employment on the grounds of pregnancy.

  • As an employer, how can I terminate an employee during their probation period?

    An employer should ensure in the first instance that their contract of employment contains a clause which stipulates how termination during probation periods will be applied. In particular, they should ensure that reference is made to whether or not the disciplinary procedure applies. In matters of misconduct, best practice suggests that some sort of fair process and natural justice  should be applied to termination during probation. 

  • How long is the probation period for new employees

    A company can determine the length of a probation period, however typically the length of probation will be three to six months.

  • Can I get maternity leave during probation period

    Yes, there is no minimum service requirement for an employee when it comes to entitlement to Maternity Leave.
